This Terms of Service (“Terms”) is a legal agreement between you (“User” or “you”) and Camera Search, Inc. (“Company”, “we”, “us”) governing your access to and use of the Camera Search application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

We reserve the right to update these Terms from time to time. If material changes occur, we will notify you via in-app notifications or other reasonable means. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.

1. Acceptance of Terms

By accessing or using Camera Search, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

All processing is performed in real time. Any data used for analysis is transmitted securely and is not retained beyond the duration necessary for providing the Service.

4. Payment, Subscriptions, and Fees

Subscription Model: The Service operates on a subscription basis. A free plan is available; a recurring subscription fee applies for premium features.
Billing: All payments are processed securely via trusted payment platforms. You are responsible for any fees incurred by your mobile carrier or internet provider.
Auto-Renewal & Cancellation: Subscriptions automatically renew at the end of each billing cycle. You may cancel at any time through your account settings. No refunds are provided for unused portions, except as required by applicable law or payment platform policies.
App Store Purchases: Subscriptions purchased through the Apple App Store are subject to Apple's terms and conditions. Payment processing is handled by Apple, and refund requests should be directed to Apple.

5. Acceptable Use and User Conduct

You agree not to use the Service for any unlawful, harmful, or abusive activities. Prohibited activities include, but are not limited to:

Engaging in behavior that infringes on the rights of others.
Attempting to modify, copy, reverse engineer, or distribute any part of the Service.

6. User Content and Intellectual Property

Your Content: You retain ownership of any content you provide to the Service (“User Content”). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, transmit, and use your User Content solely for the purpose of providing the Service.
AI-Generated Output: Outputs generated by our AI are provided for your personal, non-commercial use. You acknowledge that AI-generated content is produced by an automated system and may not be unique or error-free.
Our IP: All rights, title, and interest in the Service, including the software, models, and related technology, remain the exclusive property of Camera Search, Inc. and our licensors. No rights are granted to you except the limited license to use the Service as set forth in these Terms.

7. Third-Party Services and Integrations

9. Disclaimers and Limitation of Liability

As-Is Basis: The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be error-free, uninterrupted, or secure.
AI Accuracy: AI-generated responses are for informational purposes only. Always verify critical information with official sources and consult professionals for safety-critical work.
Limitation of Liability: In no event shall Camera Search, Inc. be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our aggregate liability shall not exceed the amount you have paid for the Service during the six months preceding the claim, subject to applicable law.

10. Indemnification

You agree to indemnify and hold harmless Camera Search, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or infringement of any rights of a third party.

11. Termination

By You: You may terminate your use of the Service at any time by closing your account.
